In this paper we will analyze critically the traditional interpretation of the principle of subsidiarity in the Chilean Constitution of 1980 and its influence on the configuration of our economic constitution. To this end, firstly we will study the traditional interpretation of the subsidiarity, trying to demonstrate its faults, and its relationship with neoliberalism. After, we will evaluate the influence of this position on the constitutional jurisprudence of recent years. The triumph of the Sandinista Revolution on July 19, 1979 marked the beginning of a period of intensification of the struggle of the insurgent movements in El Salvador and Guatemala that, encouraged by the victory of their Sandinista comrades, tried to emulate the defeat of the oligarchy in their respective countries. Nicaragua acquired a relevant role as it had not had in the region until then, becoming one of the actors that would mark the course of the isthmus during the (...) eighties of the last century. One of the effects of this new role was the strengthening of relations between the Sandinista National Liberation Front and the Nicaraguan government with the guerrillas of the Farabundo Martí National Liberation Front of El Salvador and the National Revolutionary Unity. of Guatemala. The climate of revolutionary optimism that very graphically expressed this Central American vision of the revolution was summed up in the motto of the time: "If Nicaragua won, El Salvador will win and Guatemala will follow." In Brazil, induced abortion in adolescents has been frequent in less-advantaged socioeconomic classes, and the vulnerability of these adolescents has not been addressed. Given this context, the present study sought to investigate the relationship between the practice of abortion and vulnerability in adolescents. This was a descriptive cross-sectional study of 201 adolescents who completed a structured questionnaire that allowed the analysis of variables with respect to intent to abort. The profile of the pregnant adolescents in the sample studied was the (...) following: average age, 16.1 years; stable partner; mulatas; did not use condoms during sexual relations; precocious with respect to their first sexual relations; and did not plan the pregnancy. According to the classification of the World Health Organization, 81.59% of the subjects‘ abortions were known to be induced. Twenty-one were vulnerable to induced abortion; of these, 13 reported forced sexual intercourse, of whom 8 reported that they had suffered associated violence. These results indicate that sexual violence and unwanted pregnancy subject adolescents to a context of greater vulnerability to induced abortion. Thus, it is suggested that this relationship should be considered from the perspective of bioethics and human rights, but always respecting the cultural values of the society in which the adolescents live, as well as their human dignity. El siguiente estudio trata de las repercusiones en el ámbito del derecho y de las instituciones jurídicas de la actual Revolución Genética, cuyo momento más emblemático es la clonación de seres humanos. La organización social y jurídica actual presupone una ética, la de la tradición judeocristiana, y una lógica, que se revela en la noción de un orden jurídico escalonado, según el modelo kelseniano, a partir do la constitución. Ambos presupuestos actúan como obstáculos a la investigación científica en el campo (...) de la bioingeniería, la cual, no obstante, continúa su avance imparable. De ahí que, para superar tales obstáculos, se presentan dos posibilidades doctrinales: o la flexibilización de las prohibiciones mediante el relativo abandono de los principios éticos que protegen el embrión humano, o una transformación conceptual en la concepción analítica tradicional del ordenamiento jurídico. Éste, en la futura sociedad biotecnológica, se verá paulatinamente impregnado de un hipo de racionalidad primordialmente instrumental, de carácter tecnológico, la cual tenderá a superar progresivamente a la racionalidad analítica, de carácter principiológico, característica de los actuales sistemas jurídicos. In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. Metaphysical anti-realism is a large and heterogeneous group of views that do not share a common thesis but only share a certain family resemblance. Views as different as mathematical nominalism—the view that numbers do not exist—, ontological relativism—the view that what exists depends on a perspective—, and modal conventionalism—-the view that modal facts are conventional—all are versions of metaphysical anti-realism. As the latter two examples suggest, relativist ideas play a starring role in many versions of metaphysical anti-realism. But what does (...) it mean for the existence of something to “depend on” a perspective, or for a modal fact to “depend on” a convention? We can distinguish between various dependence relations, giving rise to an array of drastically different forms of metaphysical anti-realism. This article offers a guided tour. I develop a systematic distinction between various forms of metaphysical anti-realism with a focus on the role of relativist ideas in this landscape. (shrink)

This article analyses three works or sets of works by Zubiri that I have edited. They are: “The concept of matter” and “The living being”, the “theologic trilogy” and Science and Reality. We analyze their “genesis”, and how this generates some “novelties” in Zubiri’s thinking. The article shows that in order to go deeper into what a philosopher “thinks”, it is necessary to know how his thought is progressing.

La palabra alegría es muy importante para Fernando Savater... Y es el tema central en tomo al que se articula el libro "Misterios gozosos", una antología de textos, a cargo de Héctor Subirats, que recorre 25 años de la producción filosófica y literaria de Savater. El escritor definió la palabra alegría como "afirmación del presente, no nostalgia del pasado ni del futuro". Misterios gozosos se divide, en cinco capítulos en los que se recogen las razones para la (su) alegría: (...) el solo hecho de vivir, el gusto por la comida, el buen vino, el regocijo por la polémica, el entusiasmo por lo admirado, desde figuras históricas como Voltaire o Spinoza a personajes míticos como Groucho Marx o King Kong. De hecho, Savater aparece en la portada, del libro con un pequeño King Kong en las manos. El escritor, siempre vitalista, reflexiona también en su libro sobre cuestiones de primordial interés como las drogas, la salud, los derechos humanos, el amor, la muerte o la soledad.Subirats explicó que seleccionó los textos con "mala leche, para mostar la evolución o involución de Savater". Preguntado sobre cómo ha sido la involución del escritor, Subirats respondió que "Savater permanece en su sitio. Ha sido el mundo el que se ha echado para atrás". Y Savater precisó: "Las ideas no entran en uno como en la religión. A los 20 años se piensa de una manera y a los 50, de otra. We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

Departing from the premise that the poststructuralist paradigm still reigns supreme in feminist and gender theory, that is, despite the niche efforts made in the past two decades to challenge it linked to the so called “speculative” turn or the materialisms (and realisms) emerging from the feminist field itself (such as the Utrecht School, inspired by Rosi Braidotti), we set the call for papers for the issue before you in terms that would invite authors ready to challenge the dominant epistemic (...) framework. We invited papers that engage with materialism(s), realism(s), sciences and projects engaged in rethinking the post-human beyond the poststructuralist (and, we dare say, postmodern/ist) norm. -/- . Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

A large network of alchemical agents spread from the tiny, land-locked duchy of Saxe- Gotha-Altenburg outward across Europe. At its centre, Duke Friedrich I meticulously documented his interactions with many alchemical personalities during the 1670s and 1680s. The story of one such personality illustrates the changing meanings of distant alchemical knowledge both to the inner circle of courtly alchemists and to a larger alchemical republic. Born near Gotha, Johann Otto von Hellwig built his pan-European career on a youthful stay on (...) Java. To some, this indicated his access to exotic naturalia which might be imported to a centre of collection, such as Gotha. For others, Hellwig could access a wisdom hidden abroad since ancient Egypt, which should be disseminated among widely dispersed adepts. These viewpoints indicate different functions for distant knowledge, as well as differing desired trajectories for this knowledge. (shrink)

This paper is a philosophical discussion about the link between utopianism and responsibility. It argues that our time demands a strong practice of political responsibility in both organizations and society based on what has been called ‘real utopianism’. It takes as a starting point Hans Jonas’ critique of utopianism. Keeping in mind the horrors of the Second World War this Jewish thinker disconnected the principle of responsibility from the idea of utopianism, and connected it to a ‘heuristics of fear’ – (...) we should be careful with ‘wild’ new technologies, but also with new utopian perspectives. In a second step Jonas’ predecessors and utopian thinkers Martin Buber, Ernst Bloch and Ernest Callenbach are revisited. They show that a fully conceptualized idea of utopianism includes at least three dimensions of responsibility: subsistence, justice and spirituality. I then argue that if one digs deeper into the work of Jonas, it seems that the concept of responsibility in fact implies the courage to overcome a heuristics of fear. This paper therefore argues that there is no need to radically disjunct responsibility from utopianism and that the concept of responsibility actually opens a path to ‘real utopianism’. Such a concept of responsibility can best be supported by a confessionally neutral but nonetheless spiritual eco-humanist worldview that develops a new attitude towards nature, in which (eco)asceticism, morality and spirituality become intertwined.
